Privacy Policy

We greatly appreciate your interest in our company. Data privacy is a particularly high priority for the Star Finanz AHOI management team. The Internet pages of Star Finanz AHOI GmbH (referred to hereafter as “Star Finanz AHOI”) can generally be used without providing any personal data. However, if an interested party wishes to make use of our company’s special services via our website, it may be necessary to process personal data. If the processing of personal data is necessary and there is no legal basis for such processing, we generally obtain the consent of the data subject.

The processing of personal data—for example, the name, address, e-mail address or telephone number of an individual—is always carried out in accordance with the General Data Protection Regulation (GDPR) and in accordance with the provisions of the German Federal Data Protection Act (BDSG). By means of this data privacy policy, our company would like to inform the public about the type, scope and purpose of the personal data that is collected, used and processed by us. Nevertheless, Internet-based data transmission can fundamentally have security gaps, which means absolute protection cannot be guaranteed. For this reason, every individual concerned is free to convey personal data to us using alternative methods, for example, by telephone.

Finally, the storage period is also assessed according to the statutory limitation periods, which, for example, according to §§ 195 ff. of the German Civil Code (BGB), can be up to thirty years, whereas the regular limitation period is three years.

After the period of time elapses, the data is routinely deleted.

3. Right to Rectification

You have the right to ask Star Finanz AHOI to delete your personal data immediately should one of the following reasons apply and as long as processing is not necessary (Art. 17 of the GDPR):

2. Right to Restriction of Processing

You have the right to request that Star Finanz AHOI restrict processing if one of the following conditions is met:

You also have the right to transfer this data to another responsible party without interference from Star Finanz AHOI, to whom your personal data was provided, given that the processing is based on consent pursuant to Art. 6 Para. 1 lit. a of the GDPR or Art. 9 Para. 2 lit. a of the GDPR or on a contract according to Art. 6 Para. 1 lit. b of the GDPR and the processing is carried out using automated procedures, given that the processing is not necessary for the performance of a task that is in the public interest or takes place in the exercise of official authority that has been assigned to the responsible party.

Furthermore, when exercising your right to data portability in accordance with Art. 20 Para. 1 of the GDPR, you have the right to have your personal data transmitted directly from Star Finanz AHOI to another responsible party, insofar as this is technically feasible and as long as the rights and freedoms of other individuals are not impaired as a consequence.

4. Right to Object

For reasons that may arise from your particular situation, you have the right to object (Art. 21 of the GDPR) at any time to the processing of personal data relating to you that takes place based on Art. 6 Para. 1 lit. n e or f of the GDPR. This also applies to profiling based on these provisions.

In the event of such an objection, Star Finanz AHOI will no longer process the personal data unless we can establish compelling legitimate reasons for the processing that outweigh the interests, rights and freedoms of the data subject, or the processing is for the purpose of the assertion, exercise or defense of legal claims. If Star Finanz AHOI processes personal data in order to conduct direct marketing, you have the right to object at any time to the processing of your personal data for the purpose of such advertising. This also applies to profiling insofar as it is related to such direct marketing. If you object to processing for direct marketing purposes to Star Finanz AHOI, then Star Finanz AHOI will no longer process your personal data for these purposes.

You also have the right, for reasons that may arise from your particular situation, to object to the processing of personal data relating to you that is carried out by Star Finanz AHOI for scientific or historical research purposes or for statistical purposes in accordance with Art. 89 Para. 1 of the GDPR unless such processing is necessary to fulfill a task that is in the public interest.

In connection with the use of information society services, you are free to exercise your right to object by means of automated procedures in which technical specifications are used.

5. Automated Decisions in Individual Cases Including Profiling

You have the right not to be subject to a decision based solely on automated processing—including profiling—that has legal ramifications on you or that significantly affects you in a similar manner, provided that the decision (1) is not necessary for the conclusion or fulfillment of a contract between you and Star Finanz AHOI, (2) is permissible on the basis of legal provisions of the Union or the Member States to which Star Finanz AHOI is subject and these legal provisions contain appropriate measures to safeguard your rights and freedoms and your legitimate interests, or (3) takes place with your express consent.

If the decision (1) is necessary for the conclusion or fulfillment of a contract between you and Star Finanz AHOI or (2) takes place with your express consent, Star Finanz AHOI will take appropriate measures to safeguard your rights and freedoms as well as your legitimate interests, including at a minimum the right to obtain the intervention of an individual on the part of Star Finanz AHOI to express your own point of view and to contest the decision.

6. Right to Revoke Data Privacy Law Consent

This is particularly the case if an applicant submits the corresponding application documents electronically—for example, by e-mail or via a web form on the website—to the party responsible for processing. If the party responsible for processing enters into an employment contract with an applicant, the transmitted data will be stored for the purpose of conducting the employment relationship in compliance with the statutory provisions. If the party responsible for processing does not enter into an employment contract with the applicant, the application documents will be automatically deleted two months after notification of the decision to reject, provided that deletion does not conflict with any other legitimate interests of the party responsible for processing. Another legitimate interest in this sense is, for example, a burden of proof in proceedings under the General Act on Equal Treatment (AGG).

13. Data Privacy Policy for the Application and Use of YouTube

Star Finanz AHOI has integrated components from YouTube on this website. YouTube is an Internet video portal that enables video publishers to post video clips free of charge and other users to view, rate and comment on them free of charge. YouTube permits the publication of all types of videos, which means that both complete film and television programs but also music videos, trailers or videos made by users themselves can be accessed via the Internet portal.

YouTube is operated by YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. YouTube, LLC is a subsidiary of Google Inc., 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA.

Further information about YouTube can be found at https://www.youtube.com/yt/about/. As part of this technical process, YouTube and Google receive information about which specific subpage of our website you are visiting. 15. Use of Cookies

So-called cookies are used on our website. These are data packets that are exchanged between the Star Finanz AHOI website server and the visitor’s browser. These are saved by the devices used (PC, notebook, tablet, smartphone, etc.) when visiting the website. In this respect, cookies cannot cause any damage to the devices used. In particular, they do not contain any viruses or other malware. Information is stored in the cookies that arises in the context of the specific device used. Under no circumstances can Star Finanz AHOI gain direct knowledge of the identity of the visitor to the website.

Cookies are generally accepted according to the basic browser settings. The browser settings can be configured in such a way that cookies are either not accepted on the devices used or that a particular message is displayed before a new cookie is created. It should be noted, however, that disabling cookies may mean that not all functions of the website can be used in the best possible way.

Use of cookies serves to make the website more convenient to use. For example, session cookies can be used to determine whether the visitor has already visited individual pages on the website. These session cookies are automatically deleted after leaving the website.

Temporary cookies are used to improve user friendliness. They are stored on the visitor’s device for a temporary period of time. When the website is visited again, it is automatically recognized that the visitor has already accessed the page at an earlier point in time and which entries and settings have been made so that they do not have to be repeated.

Cookies are also used to analyze visits to the website for statistical purposes and to improve the offerings. These cookies make it possible to automatically recognize that, when the website is revisited, the visitor has already previously accessed the website. The cookies are automatically deleted after a specified period of time.

The data processed using cookies are justified by the aforementioned purposes of safeguarding the legitimate interests of Star Finanz AHOI according to Art. 6 Para. 1 Cl. 1 lit. F of the GDPR.

16. Hosting

The hosting services we have utilized serve to provide the following services: infrastructure and platform services, computing capacity, storage space and database services, security services as well as technical maintenance services that we use for the purpose of operating this online offering.

In this capacity, we or our hosting provider process inventory data, contact data, content data, contract data, usage data, meta- and communication data from customers, interested parties and visitors to this online offering based on our legitimate interests in an efficient and secure provisioning of this online offering in accordance with Art. 6 Para. 1 lit. f of the GDPR in conjunction with Art. 28 of the GDPR (conclusion of an order processing contract).

17. Google Fonts

We integrate the fonts (“Google Fonts”) from the provider Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Data privacy policy: https://www.google.com/policies/privacy/, opt out: https://adssettings.google.com/authenticated.

18. Tracking, Analysis Services for Websites

We use the website analysis service Google Analytics, a web analysis service from Google Inc. (“Google”), on our website. The legal basis for using the analytical tools is Art. 6 Para. 1 Cl. 1 lit. f of the GDPR.

Google Analytics uses so-called cookies, text files that are stored on your computer and that enable your use of the website to be evaluated. Cookies help us to determine the frequency of use and the number of users of our website as well as to make our offerings as convenient and efficient as possible for you. The information generated via the cookie about your use of this website is transmitted to a Google server in the USA and stored there. Google will use this information to evaluate your use of the website, to compile reports on website activity for Star Finanz AHOI and to provide other services relating to website activity and Internet usage. Google may also disclose this information to third parties if this is required by law or if third parties process this data on behalf of Google. In order to offer you the best possible data protection, on this website we make use of the option to shorten the IP addresses sent to Google. In doing so, Google Analytics only stores part of the IP address and uses it for geographic reports. Under no circumstances will Google associate the stored part of your IP address with other Google data.

You can prevent Google Analytics from collecting data by clicking on the following link: Disable Google Analytics. An opt-out cookie is set that prevents the future collection of your data when you visit this website.

Here we would also like to note the availability of the Opt-out Add-on for browsers from Google Analytics. The opt-out gives the user the option of whether or not information about the websites they visit is recorded by Google Analytics. The add-on prevents the transmission of data when websites are visited that use the JavaScript tracking code (ga.js) from Google Analytics for data collection. You can download the add-on from the following link: https://tools.google.com/dlpage/gaoptout.

By using this website, you consent to the processing of the data collected about you by Google in the manner described above and for the purpose stated above.

In addition, this website uses the web analysis service Optimizely (from Optimizely Inc.), which is used for optimization tests on this website. The Optimizely service uses cookies to identify a visitor’s browser and to analyze the use of this website. These cookies do not collect any personal data. You can find more information about how Optimizely processes your data at www.optimizely.com/privacy. You can disable Optimizely tracking at www.optimizely.com/opt_out.

This website also uses the “Google Remarketing” retargeting service (data privacy policy and terms for advertising on Google).

Retargeting is interest-based advertising. As part of this, visitors to a website are marked and then solicited again on other websites using targeted advertising. For this purpose, Google uses stored cookies based on a user’s previous website visits.

You can disable the use of cookies for remarketing by visiting the page for disabling Google advertising.

It is also possible to make use of our offerings without cookies. You can prevent the installation of cookies by configuring your browser software accordingly. You can also delete cookies from your PC’s hard drive at any time. However, we would like to point out that in this case you may not be able to use all functions of this website to their full extent.

We would like to point out that some of the data that is collected for Google Analytics metrics is processed in the USA and that, in the opinion of the European Court of Justice (ECJ), there is no adequate level of data protection in the USA. Furthermore, the legal protection options that the EU’s Charter of Fundamental Rights is supposed to guarantee EU citizens are severely limited in the USA. In particular, there is a risk that your data may be processed by US authorities for control and monitoring purposes, possibly even without the possibility of redress. For this reason, we also obtain from you your consent to third-country processing within the meaning of Art. 49 Para. 1 lit. a) of the GDPR.

19. Legal Basis of Processing

For our company, Art. 6 Para. 1 lit. a of the GDPR serves as the legal basis for processing operations by which we obtain consent for a specific processing purpose. If the processing of personal data is necessary to fulfill a contract to which you are a party, as is the case, for example, with processing operations that are necessary for the delivery of goods or the provision of other services or return services, the processing is based on Art. 6 Para. 1 lit. b of the GDPR. The same applies to such processing operations that are necessary to carry out pre-contractual measures, for example, in the event of inquiries about our products or services. If our company is subject to a legal obligation that requires the processing of personal data, for example, to fulfill tax obligations, the processing is based on Art. 6 Para. 1 lit. c of the GDPR. In rare cases, it may be necessary to process personal data in order to protect the vital interests of the data subject or another natural person. This would be the case, for example, if a visitor to our company were injured and their name, age, health insurance data or other vital information would have to be disclosed to a doctor, hospital or other third party. In this case, the processing would be based on Art. 6 Para. 1 lit. d of the GDPR. Finally, we base certain processing operations on Art. 6 Para. 1 lit. f of the GDPR. Processing operations that are not covered by any of the aforementioned legal bases rest on this legal basis if the processing is necessary to safeguard a legitimate interest of our company or a third party, provided that the interests, fundamental rights and freedoms of the data subject do not take precedence.

20. Legitimate Interests in Processing That Takes Place by the Party Responsible or a Third Party

If the processing of personal data is based on Art. 6 Para. 1 lit. f of the GDPR, our legitimate interest is in conducting our business operations to benefit the welfare of all of our employees and our shareholders.

21. Legal or Contractual Provisions Regarding the Provision of Personal Data; Requirement for Finalizing a Contract; Obligation of the Data Subject to Provide Personal Data; Possible Consequences of Failure to Provide

We would further like to inform you that the provision of personal data is partly required by law (e.g., tax regulations) or can also result from contractual regulations (e.g., details about the contractual partner). In order to finalize a contract, it may sometimes be necessary for you to provide us with personal data that we subsequently have to process. For example, you are obliged to provide us with personal data when our company finalizes a contract with you. Failure to provide personal data would mean that the contract with you could not be finalized.

22. Existence of Automated Decision-Making

As a company that values accountability, we do not use automatic decision-making or profiling.

23. Changes to the Data Privacy Policy

We reserve the right to occasionally adapt the data privacy policy to current legal requirements as well as changes to our offerings. The current data privacy policy applies to your visit or use.
